The Pledge of Allegiance


I was reciting the Pledge of Allegiance like I do every morning, but this morning I came upon a horrible realization.

If asked, many school children would not be able to recite the 1st Amendment of the United States Constitution. Yet, school children are taught to recite the Pledge of Allegiance early in elementary school without understanding what the words truly mean. I think this is wrong.

I cannot recite the 1st Amendment verbatim either, but I pledge to learn it and recite it verbatim.
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

A federal judge sentenced tax protesters Ed and Elaine Brown to more than five years in prison yesterday, giving them sentences at the top of the range recommended by probation officers but below sentencing recommendations offered by the prosecutor.

The couple did not attend the hearing, and Ed Brown refused to recognize the sentence or the federal court that issued it.

"I've been convicted of crimes?" he asked in a phone interview yesterday.

The couple have been holed up in their fortified Plainfield home for several months, saying that any attempts to arrest them will trigger a violent confrontation with federal officials.

Re.: SB 1755, An Act relating to the collection and dissemination of certain [mental health commitment] information for a federal firearm background check.

Dear Governor Dewhurst and Senators:

The recent tragedy at Virginia Tech University should give us pause to consider how the State of Texas handles the purchase of firearms by mentally unstable persons. Although Texas participates in the National Instant Criminal Background Check System (NICS) in order to prohibit persons convicted of felonies and domestic violence from purchasing firearms, Texas is one of several states that do not turn over mental health commitment information to the United States Department of Justice’s NICS program, thereby allowing persons committed to psychiatric hospitals to easily purchase and possess firearms despite having a court finding that they are likely to cause serious harm to themselves or to others. As the local mental health judge for over twenty years, I have had numerous cases in which the evidence showed that a committed patient had threatened to shoot the President, the Governor, the Attorney General, and even yours truly. Many of these individuals were investigated by the relevant agencies and some were referred to the mental health system by these agencies. At least one of these persons was subsequently prosecuted for possession of firearms in violation of federal law after being picked up with locally purchased rapid fire automatic weapons and after admitting to the Alcohol, Tobacco, and Firearms agency (ATF) that he was interested in killing the local mental health judge, i.e., me.

This last event led me to question how it was possible for a mentally ill person committed because of dangerousness to purchase a firearm. I was surprised to find out that Texas had never passed a law allowing the dissemination of commitment information to the NICS program despite the fact that it is a federal felony offense for a person committed to inpatient psychiatric services to purchase or possess a firearm. I also found that despite Texas law forbidding a person in violation of federal law to obtain a firearm-carrying permit, that it was easy for a mentally committed person to obtain a firearm permit in Texas because the Texas licensing authority had no method of easily checking commitment information for gun permit applicants. Texas licensing authorities check NICS for felony and domestic convictions, but rely on the applicant to divulge whether or not he or she has ever been committed to an inpatient psychiatric facility. My conversations with the Texas Department of Public Safety indicate they do not check out any mental health information because there is not an easy way of accessing the information since one would have to do so by checking the 254 county clerks’ offices on a county-by-county basis. Oddly enough, Texas law does provide a clerk’s fee for a gun purchase authorization, but no County Clerk that I am aware of has ever had any law enforcement agency inquire into commitment status of gun buyers or gun carrying permit applicants.

SB 1755 (attached) filed by Senator Rodney Ellis would mandate Texas’ participation in the mental health component of the NICS program. It was referred to the Senate Criminal Justice Committee, but has not had a hearing as of this date. Senator Ellis has worked with the Department of Public Safety to fine tune the reporting procedure. He has had a Committee Substitute prepared that has the County Clerk certifying that the commitment occurred rather than having the Clerk send the DPS a certified copy of the court’s order (the committee substitute procedure now conforms to the procedure used in felonies and domestic violence cases). As a result, the DPS has indicated to the Legislative Budget Board that the bill will have no financial impact on the State of Texas (see attachment). There should be little impact on the counties as they can use the same procedures for reporting, with forms that DPS already has on hand.

A similar bill (SB 869) was filed last session, but did not get a hearing despite its being supported by law enforcement, the judiciary, and all of the state’s major mental health advocacy groups. The only opposition last session came from the National Rifle Association, which opposed the bill because it did not address a problem they have with the federal law’s process for the restoration of the right to possess weapons. Although I am a bit unclear about the NRA’s opposition to the federal restoration procedure, I do know that we cannot change federal law by passing a state law. As noted earlier, Texas already participates in NICS in regards to felons and domestic violence perpetrators. It just seems senseless not to include in the NICS database – because of the NRA’s opposition to the federal restoration procedure – the information about those who the courts have found to be dangerous, especially since we participate in sending the information on felons and persons committing domestic violence.

The NRA has not yet taken a stance on the bill this session. While they still have concerns about the federal law’s restoration provision, they are now working on resolving that issue in the United States Congress, which of course is the proper forum to address federal law.

No one can guarantee that provision of mental health commitment information will prevent tragedies such as what happened at Virginia Tech. There will always be ways for the mentally disturbed to cause harm. In the Virginia Tech situation, the killer, although looked at by mental health authorities, had never had an inpatient commitment subject to the information system maintained by NICS, but had the killer had an inpatient commitment, the NICS system would have prevented the sale of the two guns through the retail market system. I understand the gun dealer who sold the guns used in the Virginia Tech has great sorrow that he sold the gun(s), but the gun dealer bears no fault. He committed no wrong. He properly used the system that the Commonwealth of Virginia adopted to prevent the sale of guns to mentally unstable persons. The system possibly broke down elsewhere. Yet, we should try to provide as much information as possible to our gun dealers and law enforcement.

Please let there be a hearing and consideration of the merits of SB 1755.

I noticed this double standard in press coverage last week, but chose not to comment on it because, at the time, it seemed too sensitive. Yet, if a soldier says it, then I feel it is okay because a soldier has more credibility on these issues than I do.

In addition to agreeing with Sgt. Welch that the press should devote time to our soldiers, I also feel that the press coverage for Iraqi civilians killed by bombings is also under-reported.

The slaughter of civilians on the scale of the Virgina Tech killings happens almost on a daily basis in Iraq. Yet, like our fallen soldiers, it too is only given a passing mention.

President Bush said this on April 18, 2007 at Blacksburg, Va.
"Those whose lives were taken did nothing to deserve their fate," the president said.

"They were simply in the wrong place at the wrong time. Now they're gone -- and they leave behind grieving families, and grieving classmates, and a grieving nation."

WASHINGTON - April 19, 2007 - Strange things sometimes come out of President Bush's mouth. "Polls just go poof." "Remember the rug?"

When Bush went to Ohio on Thursday to talk about terrorism, he ended up musing about marriage and chicken-plucking plants, the agony of death and his Oval Office rug, which resembles a sunburst.

About his legacy, Bush said historians are still assessing George Washington, the nation's first leader. "My attitude is, if they're still writing about (number) one, 43 doesn't need to worry about it."

On being married: "A good marriage is really good after serving together in Washington, D.C."

Maybe the president just felt like jabbering at the town hall-style event in Tipp City, Ohio. He began talking about terrorism and ended 90 minutes later after chattering about everything from life after the White House to Vietnam War and the brutal Khmer Rouge regime.

Some highlights:

_"Politics comes and goes, but your principles don't. And everybody wants to be loved — not everybody. ... You never heard anybody say, `I want to be despised, I'm running for office.'"

As he has before, Bush told the story about how his first presidential decision was to pick a rug for the Oval Office, a task he quickly cast to his wife. He told her to make sure the rug reflected optimism "because you can't make decisions unless you're optimistic that the decisions you make will lead to a better tomorrow."

Later, when he talked about his hope for succeeding in Iraq, Bush said, "Remember the rug?"

I should make it clear. I don't like cellphones. But I finally submitted last month and have been carrying the bare minimum cellphone. What I mean is it only has 50 minutes and costs 6 bucks, so I have incentives to not talk on it too long.

Scientists claim radiation from handsets are to blame for mysterious 'colony collapse' of bees

They are putting forward the theory that radiation given off by mobile phones and other hi-tech gadgets is a possible answer to one of the more bizarre mysteries ever to happen in the natural world - the abrupt disappearance of the bees that pollinate crops. Late last week, some bee-keepers claimed that the phenomenon - which started in the US, then spread to continental Europe - was beginning to hit Britain as well.

The theory is that radiation from mobile phones interferes with bees' navigation systems, preventing the famously homeloving species from finding their way back to their hives. Improbable as it may seem, there is now evidence to back this up.

Colony Collapse Disorder (CCD) occurs when a hive's inhabitants suddenly disappear, leaving only queens, eggs and a few immature workers, like so many apian Mary Celestes. The vanished bees are never found, but thought to die singly far from home. The parasites, wildlife and other bees that normally raid the honey and pollen left behind when a colony dies, refuse to go anywhere near the abandoned hives.

The decimation of honeybee populations has startling implications for humans. World food production depends on the mutualistic relationship between bees and plants. Without bees, many plants can't get pollinated, and of course, we in turn depend on the plants for our food source. In other words, this is not good.

If destruction of the food supply isn't enough to make you re-think your cellphone use, consider the following:
A study by the International Agency for Research on Cancer of 4,500 users found a statistically significant link between tumor frequency and mobile phone use.

All cellphones communicate through electromagnetic microwaves with a cell site base station. I'm sure that can't be good for your brain cells.

Kids today are the first generation to heavily use these devices. They, in a sense, are guinea pigs for the long term health effects of cellphone use.

Studies in India and the US have raised the possibility that men who use mobile phones heavily have reduced sperm counts. This really concerns me because I carry my phone in my pocket right next to my nads.

Finally, in my opinion, a cellphone is an anti-social device. I've seen 4 passenger cars where none of the occupants were speaking to each other, but instead, they were on their cellphones speaking with someone else. Undoubtedly, this is because they can't stand the people sitting next to them in the car. Furthermore, a cellphone at a movie theater, funeral, wedding, library, bookstore, restaurant, or church can make you look like a supreme prick.

So, just say no to cellphones.
If you don't do it for yourself, then do it for the humble honeybee.

V's Pirate Broadcast From V For Vendetta

If you haven't seen it already, then you must check out V for Vendetta. Great movie though I wish the setting for the movie had been moved from merry old England to the United States. It would have made the movie more relevant in this day and age.

Just like most movies, the original source material is better, so if you can get a copy of the original comic book, do so. The story and artwork are incredible.

California found a better way. In 2000, that state's voters passed Proposition 36 to sentence nonviolent drug addicts to community-based treatment instead of prison. The result, according to a UCLA study, has been $1.4 billion in savings to taxpayers and 60,000 former addicts successfully completing treatment.

On Tuesday, the Senate Criminal Justice Committee heard Senate Bill 1909 by Sens. Rodney Ellis, D-Houston, John Carona, R-Dallas, and Robert Deuell, R-Greenville, which would model the California approach. Provisions in the appropriations bill would create thousands of residential and outpatient community-based drug treatment slots.

Bill-hole's Poll


Bill-hole is upset that Charlie Sheen will narrate a film version of "Loose Change." It is a 911 conspiracy video that raises some good questions. Bill-hole put up the following question: "Do you think actor Charlie Sheen will hurt his career by narrating a 9/11 conspiracy film?"

I voted on Bill-O's poll sometime last week. I think. I don't write these things down usually. Regardless, Bill-O's poll won't even give you a running count on votes or percentages.

I thought he would have announced the results by now, but he hasn't. All he's said is that there are a lot of "Kool-Aid drinkers" out there.

Wrong, I usually drink tea or beer.

Eh, maybe not so unfortunately, the Falafel Master has drowned in the Bush regime's Haliburton built Kool-Aid lake. We can only wish he chokes on his own tongue while dreaming of falafels and Kieth Olbermann, or better yet, maybe "Deadeye" Dick Cheney will take him hunting.

The Smashing Pumpkins Are Back!!!


The Smashing Pumpkins are reuniting for a new album, Zeitgeist, to be released on July 7, 2007. This is the same day they will be playing at Al Gore's "Live Earth" concert along with a reunited Genesis and Police.

James Iha stated in Rolling Stone that he would not be a part of the new tour or album. It is unclear whether D'arcy Wretzky will be on board for the new project. It will be a bummer if they are not part of the new project in my opinion.

Tour dates have been announced prior to the "Live Earth" event.

Almost Got Dang Blowed Up


We can all thank Ford Motor Co. CEO Alan Mulally for saving President Bush from killing himself.
Mulally told journalists at the New York auto show that he intervened to prevent President Bush from plugging an electrical cord into the hydrogen tank of Ford's hydrogen-electric plug-in hybrid at the White House last week. Ford wanted to give the Commander-in-Chief an actual demonstration of the innovative vehicle, so the automaker arranged for an electrical outlet to be installed on the South Lawn and ran a charging cord to the hybrid. However, as Mulally followed Bush out to the car, he noticed someone had left the cord lying at the rear of the vehicle, near the fuel tank.

"I just thought, 'Oh my goodness!' So, I started walking faster, and the President walked faster and he got to the cord before I did. I violated all the protocols. I touched the President. I grabbed his arm and I moved him up to the front," Mulally said. "I wanted the president to make sure he plugged into the electricity, not into the hydrogen This is all off the record, right?"

The xenophobe, Bill Orally, goes apeshit when Geraldo Rivera points out that he's full of crap. Falafel boy tried to tie drunk driving to immigration, but Geraldo smacks him down. I've never had much respect for Geraldo Rivera, but he's earned a bit of respect from me on this one.

It's obvious that Bill O'Reilly hates brown people. I thought either the Falafel Master's head was going to explode, or Geraldo was in for another broken nose on national tv.

Salt Lake City Mayor Rocky Anderson tries to have a civilized conversation with the Falafel Master.
This is how you treat Bill O'Reilly. On Tuesday night Bill was up to his usual tricks, but got more than he bargained for. His guest, Salt Lake City Mayor Rocky Anderson, made it clear from the beginning that he wasn't about to roll over. Anderson, who called for the impeachment of George Bush this past weekend, stuck to his guns and refused to allow himself to be painted as a loon. Every time BillO tried to talk over him, called him names and even accused him of subverting his own country, Anderson smiled and threw it back in his face. I give him credit for going on the show knowing he was going to be ambushed. We usually give the best quotes from our videos, but this one had too many to chose from. Have at it in comments.

The Trap

In his documentary "The Trap", Adam Curtis explores the business and politics of freedom.

The Trap is even more ambitious in scope. Like The Power Of Nightmares, it uses archive footage and interviews to explore the history and political impact of an idea – in this case the model of "individual freedom" that underlies neoliberal economics.

In episode one, Curtis examines the rise of game theory during the Cold War and the way in which its mathematical models of human behavior filtered into economic thought.
Episode 1 - F**k You Buddy

The second episode reiterated many of the ideas of the first, but developed the theme that the drugs such as Prozac and lists of psychological symptoms which might indicate anxiety or depression were being used to normalize behavior and make humans behave more predictably, like machines.
Episode 2 - The Lonely Robot

The final program focused on the concepts of positive and negative liberty introduced in the 1950s by Isaiah Berlin. Curtis briefly explained how negative liberty could be defined as freedom from coercion, and positive liberty as the opportunity to strive to fulfill one's potential. Tony Blair had read Berlin's essays on the topic, and wrote to him in the late 1990s, arguing that positive and negative liberty could be mutually compatible. He never received a reply, as Berlin was on his deathbed.
